Probate is the legal process of transferring the ownership of a decedent’s assets over to his or her heirs and beneficiaries. The existence of a will does not eliminate the need for probate. The will simply notifies the court who the decedent wants to receive his or her assets. You still have to probate the will to transfer the legal ownership of the assets over to the heirs.
